Increasingly, state and local governments are turning to the courts to shift the claimed cost burden of climate change adaptation. These governments have filed lawsuits seeking to hold energy companies liable under various tort and consumer protection laws (negligence, product liability, consumer protection, private and public nuisance) for the claimed effects of climate change. They allege that the largest energy companies caused pervasive use of fossil fuels by concealing their products’ contribution to climate change. Despite early setbacks, the list of cases continues to grow.
