As federal regulation of PFOA and PFOS under CERCLA becomes final on July 8, 2024, it’s more important than ever to understand the impact of these new environmental regulations on environmental liability. The designation of PFOA and PFOS as CERCLA hazardous substances introduces significant changes in environmental due diligence and risk management, along with the potential for additional environmental response actions to address PFAS at existing contaminated sites, the possibility of reopening closed sites, and the complexities associated with multi-party liability and litigation.

This presentation will provide an overview of the new regulations and focus on their impact on property transactions, enforcement and litigation, and site remediation. We will discuss some of the complexities of investigating and remediating PFAS, including the new interim federal guidance on destruction and disposal of PFAS issued on April 8, 2024, and observations from what we’ve seen in practice. Finally, we will discuss ways to minimize current and future PFAS-related environmental liability.
