While still considered emerging contaminants, disputes over PFAS have arrived—and they are here to stay. Landmark settlements by DuPont and 3M during 2017 and 2018 totaled more than $1.5 billion and sparked a wave of litigation seeking compensation for personal injury, remediation costs, and private and public property damage, among other harms. Legal settlements have already given rise to insurance claims, and the property and casualty industry expects sustained exposure. Future regulatory action and the ubiquitous nature of PFAS is sure to continue widening the swathe of defendants beyond the major manufacturers.
While any dispute over contamination involves technical issues, PFAS present a particularly daunting challenge. Because our scientific understanding of PFAS and its effects is building as the proverbial plane is flying, technical positions underlying causation, impact, damages valuation, and allocation naturally embody significant uncertainty.
