Three federal statutes, as well as some state-specific statutes, allow for the pursuit of monetary or non-monetary damages if a release of oil or hazardous substances has resulted in injury to natural resources held in trust for the public. Such claims are known as Natural Resource Damage claims, or NRD claims.
Ten years ago, NRD claims were described as “a sleeping giant,” where potential NRD claims could overwhelm actual clean-up costs. In recent years, there have been some real signs that the sleeping giant is stirring—just not at every site.
The methods used to calculate NRD claims are subject to abuse, because many of the key parameters require subjective assumptions. This webinar will discuss seven example parameters where unrealistic government assumptions can generate huge NRD claims that may be unwarranted. By performing an independent analysis of these parameters, an entity subject to an NRD claim can mount a reasonable defense and potentially reduce their liability.
